U.S. Customs Update: Beginning In July, Electronic In-Bond Filing Will Be Required

Late last year, we reported on how U.S. Customs and Border Protection (CBP) had published a final rule that adopts amendments to CBP regulations regarding changes to the in-bond process published in the Federal Register on February 22, 2012. The changes in this rule, included the automation of the in-bond process, will require in-bond applications to be submitted electronically for in-bond merchandise transported by ocean/rail/truck through ACE or ABI. (Click to see our December post)   In June, CBP released an updated FAQ regarding the implementation of this requirement with dates attached. Below you will find the most pertinent points we found from CBP In-bond webpage:   Beginning July 2, 2018: Paper CBP Form 7512 will no longer be accepted by CBP for input into ACE. Electronic filing of new in-bond transactions will be the responsibility of the trade. Paper forms or other paper alternatives (screen prints or plain paper documents etc.) will be accepted as part of enforcement processes at the border or verification/audit operations such as warehouse withdrawals, FTZ exports and transfers or vessel/aircraft supply operations where additional information is required on paper forms that is not provided for electronically.   Beginning August 6, 2018: Electronic reporting of all transactions will be mandatory; CBP will no longer accept paper copies of the CBPF 7512 to perform arrival and export functionality. These functions will be the requirement of the carrier. In addition, electronic reporting of diversion to a port other than reported on the original in-bond will be required. An ACE edit will reject arrival if not performed. Electronic reporting of bonded cargo location (FIRMS code) will be required. An ACE edit will reject arrival if not provided. At this time, no date is set for implementation of the provision requiring the 6-digit Harmonized Tariff Schedule number requirement for Immediate Transportation (I.T.) movements. Internal outreach webinars/telephone conferences will be conducted, as needed.   Remember, after the rule is fully implemented, paper in-bond will no longer be accepted. Bonded carriers will be required to file electronically either directly with CBP or through a 3rd-party service solution, such as Vilden's e-CLEAR Customs Filing Solution. UN/CEFACT Update: 31st UN/CEFACT Forum in Geneva, Switzerland

In March, we reported on our active participation in the discussions hosted by the United Nations (UN) intergovernmental body dealing with global trade efficiency and the use of IT in the supply chain sector. The United Nations Center for Trade Facilitation and Electronic Business (UN/CEFACT) was established by the United Nations Economic Commission for Europe (UNECE) and is focused on the facilitation of national and international transactions, through the simplification and harmonization of processes, procedures, and information flows, aiding the growth of global commerce. There are approximately 300 experts representing every region of the world contributing to UN/CEFACT projects, and we are excited to be a part of these discussions and share the latest information with our customers and partners.   Last month, our VP, Rajiv Garg, attended the 31st UN/CEFACT conference in Geneva, Switzerland. There were four main topics of discussion for this conference: Single Window - From border-crossing supporting documents to legally significant data exchange: This is one of the flagship topics developed by UN/CEFACT. The conference discussed the challenges of implementing a Single Window, particularly some of the document exchanges that remain out of scope. Internet of Things (IoT) - A technology that has gained headlines, IoT is a new development which allows the integration of internet-based technologies into every sphere of life, including the area of trade facilitation. This conference sought to establish a collective understanding of the potential of IoT technology for supporting trade and trade facilitation. Traceability for Sustainable Value Chains: Textile and Leather Sector - This conference brainstormed on how deep in the supply chain visibility is necessary for responsible sourcing along with current trends and possible approached for supply chain visibility within the textile and leather industries. Blockchain Conference - "Blockchain" is a decentralized technology which uses networks of computers to jointly store data which enhances trust and security. This conference continues an ongoing discussion on how this technology can be applied to the transportation industry to increase efficiency and transparency. By attending these forums, we are gaining greater insight into the evolving technologies and global standards that will help facilitate the supply chain and international trade. We will use this expertise to enhance our products and to keep our customers current on industry trends. Japan's Advanced Filing Rules (JP24) Update: Enforcement & Penalties Defined, Are You Meeting The Requirements?

Japan's 24 Hour Rule (JP24) was implemented 3 years ago (March 2014), establishing the Advance Filing Rules (AFRs) for imports to Japan. The ruling requires carriers and NVOCCs to electronically submit information on maritime container cargoes bound for a port in Japan to Customs, in principle no later than 24 hours before departure of the vessel from the port of loading. Late last month, Japan Customs published an open letter, detailing their renewed focus on enforcement and defining penalties for shipping companies/NVOs that fail to file on time or inaccurately. The main highlights of this document can be summarized into 3 main points: The letter reiterates that NVOs are required to file appropriate cargo descriptions (vessel code, voyage number, Master B/L Number, presence/absence of House B/L, etc.). This also applies to shipping companies (VOCCs) that are filing on behalf of their NVO customers. Japan Customs will be vigorously enforcing JP24, as they feel there are too many cases in which cargo information is filed with inappropriate descriptions, or filed late. Shipping companies or NVOs that fail to file cargo information by the deadline, will incur penalties that may include; imprisonment with labor for up to year, a fine up to five hundred thousand yen. Additionally, inappropriate filings could lead to a delay in discharging or delivering the cargo in question, leading to additional hardship for the shipping company/consignees.  If there are any doubts on whether you are filing accurate information and meeting the requirements, we encourage you to contact our professionals to review your filing process.
