U.S. Customs in conjunction with the Ports of NY-NJ released an update regarding the enforcement of the Importer Security Filing regulation that went into affect July 2013. Specifically, the update addresses how liquidated damages can be assessed with failure to report the requirements. CBP may also withhold the release or transfer of cargo until the ISF reporting requirements are met as well.
While this letter was released from the New York/New Jersey sector, other ports may be making updates to their enforcement procedures as well. It would be wise to ensure that your operations are meeting the ISF requirements ahead of time. If you have concerns whether your process is sufficient, Vilden Associates can assist you with your ISF filing needs, supported through our cloud-based e-CLEAR solution.
