The Port of Los Angeles (POLA) plans to enforce a recent ruling by the 9th Circuit Court to uphold some of the concession requirements found within the clean-truck plan. These concession requirements relate to provisions covering motor carrier financial responsibility, truck maintenance and off-street parking requirements.
After winning an appeal on the employee-driver mandate portion of the requirements, the American Trucking Association (ATA) also plans to appeal the latest verdict over financial responsibility. However, until the verdict is appealed, the POLA plans to enforce the ruling. Last week, the port also announced they will not appeal the decision on the employee –driver mandate.
