The battle over the new Hours of Service (HOS) regulation continues in the capitol this week. Yesterday, representatives from the trucking industry, including the American Trucking Association (ATA), called on the Federal Motor Carrier Safety Administration to address the problems that have begun to surface now that the HOS ruling has been implemented. Citing two studies conducted by the ATA and another trucking association, the trucking representatives point to data showing that the ruling has already cut driver’s pay and may be actually raising the fatiguing the truckers on America’s highways. The statistics from the member companies are showing that productivity has declined 3 percent to 4.5 percent due to the new hours restrictions (both solo and team operations).
After the U.S. Appellate Court decided to uphold the majority of the new law in early August, the ATA and other representatives of the industry have been calling on Congress to step in to halt the implementation. Last month, some lawmakers put forth a bill to freeze the ruling until the data is completely collected.
The debate continues today, as FMCSA Administrator Anne Ferro will be testifying at a subcommittee hearing. With a presentation titled , “WRONG WAY: The Impact of FMCSA’s Hours of Service Regulation on Small Businesses.”, one can expect that today’s discussions will be contentious. The House is also putting pressure on the Department of Transportation to provide data from its study of the impacts of the HOS ruling. Stay tuned as the hearings continue.
